In this case, it will likely be necessary for a neutral 3rd party expert fact-finder to measure the foreseeability of risk of having inoperable fire sprinklers. The level of risk found will have a large amount of influence on the ultimate liability of CI. Depending on the results, OC may or may not assume full liability for the fire. If the level of risk created by CI’s actions constitutes gross negligence, OC may not need to assume full liability for the fire.
